USING THE WEBSITE CONTENT
The contents of the Website, including all text, graphic design, graphics, images, photographs, including snapshots, exhibited on the Website, as well as the selection and arrangement of the sets contained on the Website (“Contents”), are protected under current Czech law on copyright and associated rights and related amendments (Act no. 121/2000 Sb.; hereafter “Copyright”). PPF is the sole copyright holder of the Website and all its contents.
Regardless of the aforementioned, some materials, photographs, images, or text exhibited by PPF on the Website (particularly the trademarks and logos) may be the property of third parties, and may therefore be protected under relevant regulations for the protection of intellectual property rights.
The Content of the Website may not be reproduced, altered, or used commercially in any way, except in cases expressly stated below in these Terms and Conditions. Without thereby limiting the general validity of the restrictions mentioned in the previous paragraph, you may not in particular do any of the following without the prior written permission of PPF:
- redistribute the Content, transfer it, republish it (including as part of a library, archive, or similar service);
- create a database in electronic form or structured manual form by the systematic downloading and storage of the whole Content or any of its parts.
When using the Website, you may not compromise the security, integrity, or, in short, the operation of the Website, or use the Website for the transfer of harmful files or try to enter potentially private areas of the Website. Furthermore, you are obliged to respect PPF’s copyright to the Website and also the rights of third parties to the materials and texts presented by PPF on the Website (particularly trademarks and logos), which are the property of third parties and enjoy protection under relevant regulations for the protection of intellectual property rights. You have no right to these articles of intellectual property. You may not dispose of these articles of intellectual property in any way without the prior written permission of PPF.
Special terms for using the Photographs
The term “Photograph” includes all photographs that have been placed on the Website, particularly photographs of works of art exhibited in the Josef Sudek Studio, which are protected by copyright, in digital form, and any textual information related to them, as lower-definition images (hereafter “Preview Photographs”).
Entering the database and looking through it is free of charge.
Authorized use of Preview Photographs
- as a resulting product of the user of the Website;
- in connection with a resulting product of the user of the Website;
- public distribution;
- on-line distribution or distribution by means of another distribution system.
PPF therefore grants you no other permission with regard to the Preview Photographs.
Authorized use of Print-quality Photographs
The use of Print-quality Photographs always depends on the prior written permission of PPF.
To obtain permission to use Print-quality Photographs, please fill in the electronic “Request” form. In the request, state the purpose for which you intend to use the Print-quality Photograph and to what extent and for how long. With regard to the aim and time span for the use of the Photographs, which you shall state in the request form, it will be exclusively up to PPF whether your request will be granted or turned down and whether you will be able to use the Print-quality Photograph. In order to obtain permission to use the Print-quality Photograph, you are obliged to provide complete and true information when filling in the request form. If your request is granted, you will be able directly to download the Print-quality Photograph through the Internet from the server and to use it for the purpose stated in the Request.
In no case are you entitled to dispose of the Print-quality Photograph as you see fit. The user who has been granted permission to download a Print-quality Photograph commits himself or herself to use that Photograph only in keeping with the aim and in the way and to the extent for which he or she has been permitted to download the Print-quality Photograph and to use it, and only once.
For the avoidance of doubt, it is hereby stipulated that unless otherwise expressly stated by PPF, namely, on the basis of your Request, the following in particular is forbidden:
- to transfer, sell, or in any other way provide for use to another person or to make available to this other person a Photograph downloaded in print quality;
- to make a copy of a Photograph downloaded in print quality;
- to use a Print-quality Photograph for any purpose other than that for which PPF has granted permission;
- to use a Print-quality Photograph to an extent or in a way other than that for which PPF has granted permission;
- to copy, alter, change, transform, or otherwise manipulate a Photograph;
- to use a Print-quality Photograph in any country other than the Czech Republic.
It is, furthermore, expressly forbidden to do any of the following with a Photograph downloaded in print quality:
- to include it in materials or to link it to works or materials in violation of Czech law and in disregard of ethical standards, or posing a threat to public order, or by its content not corresponding to the interests or intentions of PPF, with misleading or false reports or materials, or materials that affect the rights and legitimate interests of PPF and Affiliated Companies or other third parties, with materials that are counter to human dignity and/or are by their content discriminatory with regard to religion, race, sex, and/or propagate violence or any other illegal behaviour;
- to use it contrary to the interests of the photographer or in a way that constitutes an infringement of the rights or legitimate interests of the photographer of the Photograph or of third parties.
You are in no way entitled to transfer, sub-licence, or assign to third parties the permission granted to you by PPF to use Photographs downloaded in print quality.
The right to use a Print-quality Photograph arises on the day when PPF granted permission, but only for the purpose and to the extent and in the way for which PPF granted its permission.
“Preview Photographs” a Print-quality Photograph is not an exclusive right. PPF is entitled to grant the same right to other entities, or to grant a third party the exclusive right to use certain Print-quality Photographs, and thereby to limit your right to use the selected Print-quality Photographs (unless otherwise agreed).
- such use of the Photograph may be considered prejudicial to the rights and legitimate interests of PPF;
- PPF is entitled to demand you to pay contractually stipulated damages to the sum of 50 000 Kč (fifty thousand Czech crowns); the indemnity is unaffected by this;
- you shall compensate PPF for all damages that arise with the violation of the aforementioned terms and conditions, which have thereby resulted in an infringement of the photographer’s/photographers’ copyright or that of third parties.
In the event that you request to combine the Photograph with an authorial work (of literature or art), PPF reserves the right to ask you to present the work for approval.
After using a Photograph, you are obliged, and pledge, to delete each Photograph from the storage device on which you have stored the Photograph.
In the event of violating the terms and conditions stated in the previous two paragraphs, PPF shall be entitled to demand from you the payment of contractually stipulated damages to the sum of 10 000 Kč (ten thousand Czech crowns).
With regard to contractually stipulated damages, it shall generally hold that the payment of contractually stipulated damages does not relieve you of the responsibility to pay compensation for damages that have been incurred by PPF. The amount of the contractually stipulated damages is not included in the compensation for damages incurred by PPF.
If you are interested in using the Photograph on behalf of your employer, you shall state, and thereby commit yourself, that you have been authorized to this licence agreement on behalf of your employer.
LIMITATION OF LIABILITY
The Content of this Website is intended for the public. All information provided on the Website is solely for your information and is intended for general use. Some of the information published on the Website has been taken by PPF from other sources that it considers reliable. PPF, however, in no case vouches for the correctness or current relevancy of the published information.
PPF has done all it can to ensure the reliability and accuracy of the information published on the Website, but technical or typographical errors may occur. Once these have been determined, they may be corrected if PPF deems it fit.
PPF bears no responsibility for possible damages that the users may incur in connection with using the Website.
In view of the number of sources from which PPF acquires its Content, and in view of the nature of electronic distribution by means of the Internet, PPF provides no guarantee as to the Website, Content, software, or services that are available through the Website (collectively “Website Services”). The Website Services are, in particular, provided “as is” with all their mistakes and as available. To the extent provided by the relevant legislation, PPF thereby refuses any guarantees, terms and conditions, or duties of any nature, in particular guarantees of competence for a certain purpose, express or statutory warranty, or warranty or responsibility concerning the accuracy, timeliness, and completeness of the Content and Website Services.
The Website contains links to other Websites on the World Wide Web provided by independent third parties (“Third-Party Websites”), either directly or by frames. When visiting Third-Party Websites you should familiarize yourself with the terms and conditions of using them. PPF is not responsible for the rules and procedures of other parties or for the content or availability of linked Third-Party Websites, and will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such Third-Party Websites.
PROTECTION OF PERSONAL DATA
PPF respects the privacy of the users of its Website. PPF collects only personal data (for example names and addresses or e-mail addresses) that has been provided to PPF voluntarily by the users themselves. PPF uses this data solely for the purposes for which the data was provided. Occasionally the data may be used to link PPF with the user in order better to determine the users’ needs.
PPF does not exclude the possibility that access to some parts of the Website or the provision of particular Website content may be conditional upon the provision of some personal data in the best form of the Personal Data Protection Act (no. 101/2000 Sb.) and Amendments to Other Acts, as amended. In such a case, PPF pledges to deal with personal data provided by the user in accordance with the Personal Data Protection Act (no. 101/2000 Sb.) as well as other laws, as amended.
PPF, in connection with the possible gathering of personal data as mentioned above, pledges to store the provided personal data securely and to protect it from unauthorized manipulation by third parties, to protect it from misuse, theft, or publishing. The personal data provided will be stored on a computer server in a controlled and protected environment ensured by modern hardware and software.
Part of the Website may contain information from third parties (“Contributors”). Contributors are responsible for ensuring that material submitted for inclusion on the Website complies with the law. PPF is not responsible for any error or inaccuracy in material provided by Contributors.
“Cookies” are information files that are transferred from the Website to the hard disc of the user’s computer. With the help of cookies, the Website remembers certain information, which facilitates the use of the Website for the user.
